Drug traffickers such as Rafael Caro Quintero, Joaquín "El Chapo Guzmán" Loera, Ernesto Fonseca Carrillo "Don Neto", Miguel Ángel Félix Gallardo and Pablo Emilio Escobar Gaviria, not only want to stand out for being part of criminal groups with international influences, they also want transcend as a brand.
Such is their purpose that some of them have already processed the registration of their names, nicknames, faces, signatures, and even fingerprints, as a registered trademark before the Mexican Institute of Industrial Property (IMPI).
According to El Universal , the bosses Chile Mobile Number List want to obtain exclusivity of the word "narcos"; the name of the criminal organization Los Zetas; or names like The Lord of the Skies, The Queen of the Pacific and The Queen of the South; characters such as Tereza Mendoza, La Mexicana and even the image and name of Jesús Malverde, who is known as the patron saint of drug traffickers, this in order to use them as names and logos of products, ranging from alcoholic beverages, religious articles and films films to clothing and jewelry.
In recent years, these names have circulated in television series, movies and even fashion design, but not all have been successful.
The Mexican Institute of Industrial Property (IMPI) has rejected most of the applications, arguing that there are legal impediments established in Industrial Property and Copyright laws.
The institute says that it refuses to register brands with these names because they have references linked to characters who threaten morality and public order.
Among those who did obtain registration is Ernesto Fonseca Carrillo, known as "Don Neto", who is founder of the extinct Guadalajara Cartel in the 1980s. In 2009 he registered his name to be used as a brand in alcoholic beverages, to which the institute found no impediments and granted the concession.
On the other hand, Rafael Caro Quintero's romantic partner, Diana Espinoza Aguilar, also registered her name and was rejected, since she did not have the authority to claim the boss's name; However, Caro Quintero issued a power of attorney granting him the power to assign the rights.
One of the most recent cases is that of Miguel Ángel Félix Gallardo. A few months ago the institute received the request, however, it has not yet issued a statement or resolution on the concession.
Regarding Joaquín El Chapo Guzmán's trademark, the registration is awarded to two people: the capo's daughter, Alejandrina Gisselle Guzmán Salazar, and his wife, Emma Coronel Aispuro; However, the name and image were registered in different ways.
In 2011, Alejandrina Gisselle Guzmán attempted to register as “El Chapo Guzmán” and “ Joaquín El Chapo Guzmán” , but the IMPI reported the refusal, because there were legal impediments to the registration.
Despite this, in April 2019, the daughter of the drug trafficker imprisoned in the United States launched a clothing line inspired by her father's name and image. Some of the procedures are still in litigation.
